Employers liability insurance limits on UK tender notices — reading for SMEs

Contracts Finder and Find a Tender notices for cleaning, FM and trades work often state minimum employers liability (EL) cover alongside public liability. For UK employers, EL is a legal requirement when you employ staff — but the buyer’s stated minimum limit can still be a pass/fail gate in the SQ. This guide helps facilities and trades SMEs read EL wording at notice stage. Not insurance advice and not bid writing.

Not insurance advice. Not bid writing. BidFit emails tender matches from Contracts Finder and Find a Tender and writes sourced Go / No-go memos when asked. We do not broker policies or complete SQ uploads.

Why EL limits appear on notices

Buyers want evidence that bidders can meet statutory employer duties and indemnify the authority if your employee is injured on site. EL minimums are often copied from corporate insurance schedules — sometimes £5m or £10m even on modest-value lots.

Pair with public liability gates, turnover requirements, and notice-visible vs pack-only gates so you triage all insurance lines together.

Notice vs pack

Published summaries may omit insurance tables that live in the ITT. Procurement Act notices may group insurance under selection criteria — see Procurement Act notice fields.

If EL is silent on the notice, mark Unknown until the pack opens — same discipline as performance bond wording.

Framework call-offs may inherit EL minimums from the framework schedule without repeating them on the mini-competition notice — framework call-offs vs open tenders.

TUPE and agency staff

TUPE transfers can change who employs site staff mid-contract — EL evidence may need updating at mobilisation. Read TUPE cues beside TUPE wording on Contracts Finder.

Notices referencing agency or temporary labour may still require your EL for anyone you employ directly. Do not assume the buyer's agency covers your EL obligation.

Multi-site FM contracts may ask for EL certificates per bidding entity in a joint venture. Read subcontracting opportunity wording when labour supply chains are split across lots.

Evidence the SQ usually wants

Selection questionnaires typically ask for a copy of your EL certificate or broker letter showing policy number, limit, and expiry. Some buyers want cover uninterrupted from submission through contract start — diary those dates in your triage memo.

If you employ zero staff today but plan hires at mobilisation, the notice may still require EL at submission. Treat that as a commercial gate — obtain broker guidance outside BidFit.

Motor and public liability certificates often appear in the same SQ tab. Upload each document against the correct row; mis-labelling EL as PL is a common desk error that fails automated checks.

What the notice does not tell you

Notice text rarely confirms whether the buyer accepts EL run-off cover, whether joint names are required, or whether overseas parent policies satisfy the gate. Those answers live in the insurance schedule or clarification log.

BidFit memos cite EL minimums you point us to on the notice or pack. We do not verify certificates or negotiate policy wording with buyers.

Worked example

A school cleaning notice states: “Tenderers must hold employers liability insurance of not less than £10,000,000 per claim.” Triage notes:

Questions

Where do employers liability limits appear on a tender notice?

Often in mandatory requirements, insurance schedules, or SQ pass/fail sections. Some notices only state EL in the ITT pack — mark Unknown until the pack opens.

Is £10m employers liability normal for a small cleaning contract?

Not always proportional. Buyers sometimes paste framework insurance schedules onto small lots. Compare the stated EL minimum to contract value and your existing policy schedule.

Does employers liability wording cover subcontractors?

The notice or pack may require EL for your direct employees only, or ask how you verify subcontractor EL. Read the exact entity and induction evidence lines.

Will BidFit advise on upgrading employers liability cover?

No. BidFit memos flag stated EL minimums from the notice or pack against the profile you provide. Insurance decisions remain yours.

How does EL relate to public liability gates on the same notice?

They are separate policies with separate minimums. Fail either stated minimum in the SQ and you are out — see the public liability guide for PL triage.
