Public liability insurance limits on UK tender notices — reading for SMEs

Contracts Finder and Find a Tender notices for cleaning, FM and trades work often state minimum public liability cover alongside employers liability. The buyer's stated minimum can be a pass/fail gate in the SQ even when your existing policy feels adequate for contract size. This guide helps facilities and trades SMEs read PL wording at notice stage. Not insurance advice and not bid writing.

Not insurance advice. Not bid writing. BidFit emails tender matches from Contracts Finder and Find a Tender and writes sourced Go / No-go memos when asked. We do not broker policies or complete SQ uploads.

Why PL limits appear on notices

Buyers want evidence that bidders can indemnify the authority if third parties are injured or property is damaged during contract delivery. Public liability minimums of £5m or £10m appear on cleaning, FM, grounds and trades notices even when contract value is modest.

For UK SMEs, PL is commercial insurance rather than a universal statutory minimum like employers liability — but the buyer's stated limit is still a pass/fail gate in many selection questionnaires.

Pair with employers liability gates, public liability and contract value, and notice-visible vs pack-only gates.

Notice vs pack

Published summaries may omit insurance tables that live in the ITT. Procurement Act notices may group insurance under selection criteria — see procurement act notice fields.

If PL is silent on the notice, mark Unknown until the pack opens — same discipline as performance bond wording and carbon reduction plan lines.

Read Procurement Act notice fields and performance bond wording.

Multi-site and TUPE context

Multi-site FM contracts may ask for PL certificates per bidding entity in a joint venture. TUPE transfers can change operational risk mid-contract — read TUPE cues beside insurance lines.

Notices referencing subcontractor labour may still require your PL for work you deliver directly. Do not assume the buyer's panel covers your indemnity obligation.

See TUPE wording on Contracts Finder and subcontracting opportunity wording.

Evidence the SQ usually wants

Selection questionnaires typically ask for a copy of your PL certificate or broker letter showing policy number, limit, and expiry. Some buyers want cover uninterrupted from submission through contract start.

If you operate through a holding company but bid via an SPV, the pack may require PL in the bidding entity's name — read entity rules before assuming group cover passes.

What the notice does not tell you

Notice text rarely confirms whether the buyer accepts run-off cover, whether joint names are required, or whether overseas parent policies satisfy the gate. Those answers live in the insurance schedule or clarification log.

BidFit memos cite PL minimums you point us to on the notice or pack. We do not verify certificates or negotiate policy wording with buyers.

Worked example

A grounds maintenance notice states: “Tenderers must hold public liability insurance of not less than £5,000,000 per claim.” Triage notes:

Framework and joint venture context

Framework schedules may state PL minimums once for all call-offs. Mini-competition notices might not repeat the figure — still check the framework insurance tab before bidding.

Joint ventures must read which entity's policy satisfies the gate — pack-only rules often name the bidding SPV.

Questions

Where do public liability minimum limits appear on a tender notice?

Often in mandatory requirements, insurance schedules, or SQ pass/fail sections alongside employers liability. Some notices only state PL in the ITT pack — mark Unknown until the pack opens.

Is £5m public liability normal for a small FM contract?

Buyers often paste framework insurance schedules onto modest lots. Compare the stated PL minimum to contract value and your policy schedule — proportionality does not remove a stated gate.

Does public liability wording cover subcontractors?

The notice or pack may require PL for your organisation only, or ask how you verify subcontractor cover. Read entity and induction evidence lines separately from EL.

Will BidFit advise on upgrading public liability cover?

No. BidFit memos flag stated PL minimums from the notice or pack against the profile you provide. Insurance decisions remain yours.

How does PL relate to employers liability on the same notice?

They are separate policies with separate minimums. Fail either stated minimum in the SQ and you are out — triage both in one memo row.
