Anti-bribery and corruption wording on UK tender notices — reading for SMEs
Contracts Finder and Find a Tender notices increasingly ask bidders to confirm anti-bribery policies, training and gifts registers alongside modern slavery and fair payment attestations. For a small contractor, the early question is whether ABC wording is pass/fail in the SQ or only scored as social value. This guide helps you read anti-bribery lines at notice stage. Not legal advice and not bid writing.

Why anti-bribery lines appear on notices
Public sector buyers increasingly ask bidders to confirm anti-bribery and corruption policies, training programmes, and gifts-and-hospitality registers before award. Facilities, cleaning and trades SMEs see those attestations beside modern slavery, fair payment and social value lines on Find a Tender and Contracts Finder.
At notice stage the bid/no-bid question is whether ABC wording is pass/fail in the selection questionnaire, a scored ethics question, or absent until the pack opens.
Pair with modern slavery statement wording, fair payment terms wording, and notice-visible vs pack-only gates.
Common wording patterns
| Notice phrase | What to record | Triage note |
|---|---|---|
| Anti-bribery and corruption policy | Policy existence gate | Often SQ pass/fail |
| Bribery Act 2010 compliance | Statute reference | Read attestation scope |
| Gifts and hospitality register | Operational control | May need sample redacted log |
| Subcontractor ABC flow-down | Supply-chain gate | Relevant if bidding as tier two |
| Training records for staff | Evidence type | Pack may specify frequency |
Notice vs pack
Published notice HTML may list ethical procurement without reproducing ABC questionnaire text. Procurement Act notices may group attestation themes under participation requirements — see procurement act notice fields.
If anti-bribery is silent on the notice, mark Unknown until the ITT or SQ opens — same approach as cyber assurance and performance bond gates.
Read Procurement Act notice fields and evaluation criteria weighting when ethics is scored rather than pass/fail.
Relationship to modern slavery and social value
Buyers sometimes paste one ethical procurement paragraph covering slavery, ABC and living wage themes. Split each theme in your triage sheet — social value scoring may still be separate from ABC pass/fail attestations.
Subcontracting opportunity notices may require primes to flow ABC clauses to agencies — read subcontracting wording when agency labour is in scope.
Cross-read social value wording, subcontracting opportunity wording, and living wage wording.
What the notice does not tell you
Notice text is not an ABC policy template. It does not confirm acceptable policy formats, board approval dates, or how subcontractors must evidence training.
BidFit memos cite ABC lines you point us to on the notice or pack. We do not audit compliance programmes or write attestation answers.
Worked example
A hospital cleaning notice states: “Tenderers must confirm they operate an anti-bribery and corruption policy compliant with the Bribery Act 2010 and provide evidence of annual staff training.” Triage notes:
- Policy gate: Named ABC policy — confirm document exists and is board-approved.
- Training evidence: Annual frequency — gather LMS exports before SQ day.
- Pass/fail: Likely SQ section — treat as gate unless pack scores ethics.
- Subcontractors: Unknown on notice — check pack for flow-down clauses.
Common misreadings
- Modern slavery statement treated as ABC policy. Separate documents and SQ rows.
- Generic ethics PDF assumed to satisfy Bribery Act wording. Read exact attestation language.
- Framework admission assumed for every call-off. Mini-competitions may re-ask ABC status.
- Gifts register omitted because notice only says policy. Pack may require operational evidence.
Notice triage checklist
| Check | On notice? | If missing |
|---|---|---|
| Named ABC / Bribery Act reference | Sometimes | Unknown until pack |
| Training frequency stated | Rarely | SQ instructions |
| Subcontractor flow-down | Sometimes | Pack schedule |
| Separate from modern slavery line | Often | Two gates — do not merge |
| Valid at submission and award | Sometimes | Diary policy review dates |
Framework and call-off context
Framework terms may embed ABC attestations for every call-off. Mini-competition notices might not repeat every SQ line — still check the framework ethical procurement tab before bidding.
DPS and open frameworks can inherit the same ABC gate on each mini-competition — read DPS mini-competition wording when you are not bidding a standalone open procedure.

Questions
Where does anti-bribery wording appear on a tender notice?
Look in selection criteria, ethical procurement sections, or attestation questions referenced from the notice. Full ABC policy templates are often pack-only.
Is anti-bribery the same as modern slavery attestation on a notice?
No. Modern slavery lines focus on supply-chain transparency; anti-bribery lines focus on corruption prevention policies and training. Read each field separately.
Will BidFit draft an anti-bribery policy?
No. BidFit emails tender matches and writes sourced Go / No-go memos. We do not draft policies or SQ responses.
Do SMEs below certain turnover thresholds still see ABC gates?
Buyers may require ABC policies regardless of company size on public contracts — read the exact attestation wording in the pack rather than assuming exemption from the notice title alone.
What if the notice is silent on anti-bribery?
Mark Unknown until the SQ opens. Framework call-offs may inherit ABC requirements without repeating them on the mini-competition notice.
